These Terms and Conditions ("Terms") govern your use of the Xpedioair USA website and flight modification services. By submitting a request through our platform, you agree to be bound by these Terms. Please read them carefully before using our services.

✅ Acceptance of Terms

By accessing our website, submitting a flight change request, or making a payment, you confirm that you: (a) are at least 18 years of age; (b) have the legal authority to enter into this agreement; and (c) agree to these Terms and our Privacy Policy. If you are submitting a request on behalf of another person, you warrant that you have their authorization to do so.

✈️ Description of Services

Xpedioair USA provides flight modification facilitation services, including:

• Flight date, time, and route changes
• Passenger name corrections
• Seat selection changes and cabin upgrades
• Cancellation and refund facilitation

Our service consists of contacting the relevant airline on your behalf and requesting the modification you specify. We use our expertise to navigate airline policies, fee waiver opportunities, and the 24-hour DOT rule. However, the final decision on any change rests solely with the airline, and Xpedioair cannot guarantee that any particular change will be approved.

💵 Fees & Payment

Our service fee of $39.99 is charged per request in addition to any airline-imposed fees. By proceeding to the payment page, you authorize Xpedioair to charge the displayed amount.

• All fees are displayed clearly on the pricing page before payment
• Airline fees are estimates based on published maximums and may be lower
• Payment is processed via PCI-DSS compliant processors
• Receipts are sent to the email address provided

Refunds are governed by our Refund Policy. In the event that the airline cannot fulfill your requested change, Xpedioair's service fee will be refunded in full.

🧑 Your Obligations

By using our services, you agree to:

• Provide accurate and complete information in your change request
• Not misrepresent your identity, booking details, or the nature of your request
• Use our services only for lawful purposes
• Not attempt to defraud Xpedioair, airlines, or payment processors
• Not engage in chargebacks for services rendered in good faith
• Not reverse-engineer, scrape, or use automated tools to access our website

⚖️ Limitation of Liability

To the maximum extent permitted by law, Xpedioair's total liability to you for any claim arising from your use of our services is limited to the amount you paid to Xpedioair for the specific request giving rise to the claim.

Xpedioair is not liable for:

• Airline decisions to deny, delay, or differently fulfill a change request
• Airline-imposed fees or fare differences
• Any consequential, incidental, indirect, or punitive damages
• Loss of travel opportunities, accommodation costs, or other travel expenses
• Inaccuracies in airline fee information displayed on our site

🏛️ Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions. Any dispute arising from these Terms or your use of our services shall be resolved by binding arbitration under the rules of the American Arbitration Association, on an individual basis. Class action lawsuits are waived to the fullest extent permitted by law.

Before initiating arbitration, you agree to first contact us at legal@Xpedioair.com to attempt to resolve the dispute informally within 30 days.

🔄 Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by email and posted on our website with at least 14 days' notice. Continued use of our services after the effective date of any changes constitutes your acceptance of the new Terms.
